GENERAL TERMS AND CONDITIONS OF SALE
Preamble
These General Terms and Conditions of Sale govern all transactions carried out on the kelia-paris.fr website. Any order implies the full and unreserved acceptance of these conditions by the customer.

Article 2 – Scope of Application
These General Terms and Conditions of Sale apply exclusively to sales concluded between KELIA and any end consumer making a purchase on the kelia-paris.fr website. The products offered are for personal use and cannot be subject to commercial resale.
Article 3 – Products
KELIA creations are designed in Paris and produced in limited series, demonstrating exceptional artisanal know-how. The photographs presented on the website are non-contractual. Slight variations in shades or finishes may appear due to screen settings or the artisanal manufacturing process, without this constituting a defect.
Article 4 – Pre-order
Products offered for pre-order are manufactured after order validation. A reservation deposit of €648 is required upon order, the remaining balance of $648 is requested before shipment. The customer acknowledges that delivery times may be longer than for an in-stock product. Any pre-order can be cancelled as long as the product has not been shipped. In this case, a full refund will be made via the initial payment method. Once the order has been shipped, standard return conditions apply.
Article 5 – Order
The order is definitively validated after shopping cart confirmation, express acceptance of these General Terms and Conditions of Sale, and full payment of the due amount. A confirmation email is sent to the customer after the transaction.
Article 6 – Prices
Prices are expressed in euros, all taxes included. Delivery costs are indicated before the final validation of the order. The applicable price is that in effect at the time the order is placed. KELIA reserves the right to modify its prices at any time, it being understood that validated orders remain subject to the price accepted at the time of their validation.
Article 7 – Payment
Payment is made online securely via the Shopify platform. Accepted payment methods include credit card, Apple Pay, and PayPal, depending on availability. Payment is due in full at the time of order.
Article 8 – Retention of Title Clause
Products remain the property of KELIA until full payment of the price by the customer, regardless of the delivery date.
Article 9 – Delivery
9.1 – Delivery Zones
KELIA delivers in metropolitan France and internationally. Delivery costs and times are calculated automatically during the finalization of the order and vary depending on the chosen destination.
9.2 – Deliveries outside the European Union
For deliveries outside the European Union, customs duties, import taxes, or administrative fees may be required by local authorities. These fees remain the exclusive responsibility of the customer and are not included in the order amount.
9.3 – Methods
Orders are shipped to the address indicated by the customer during validation. It is the customer's responsibility to check the accuracy of the information provided. KELIA does not offer in-store pickup service.
Article 10 – Right of Withdrawal
In accordance with the legal provisions in force, the customer has a period of thirty (30) days from receipt of the product to exercise their right of withdrawal, without having to give reasons or bear penalties, with the exception of return costs which remain at their expense.
To exercise this right, the customer must notify their decision by email to contact@kelia-paris.fr or by using the withdrawal form attached hereto.
Article 11 – Returns and Refunds
11.1 – Return Conditions
Returned products must imperatively be in their original condition, unworn, unused, accompanied by all their accessories, their original packaging, and the purchase invoice or a copy thereof. Any incomplete, damaged, or soiled product by the customer will not be accepted.
11.2 – Return Costs
Return costs are the responsibility of the customer, except in the event of a preparation error or a defective product attributable to KELIA.
11.3 – Refund
The refund will be made within a maximum of thirty (30) days from the receipt of the returned product or the receipt of proof of shipment of the return by the customer. The refund will be made using the same payment method as that used during the order, unless expressly agreed by the customer for another method.
Article 12 – Legal Guarantees
12.1 – Conformity Guarantee
In accordance with articles L. 217-4 et seq. of the Consumer Code, the customer benefits from the legal guarantee of conformity. The product must conform to its description and have the advertised qualities.
12.2 – Hidden Defects Guarantee
In accordance with articles 1641 et seq. of the Civil Code, the customer is protected against hidden defects rendering the product unfit for its intended use.
Article 13 – Personal Data
Personal data collected during the order is subject to computer processing intended for order management and customer relationship. For any information relating to the collection, processing, and protection of your personal data, we invite you to consult our Privacy Policy accessible on the website.
Article 14 – Intellectual Property
All elements of the kelia-paris.fr website (texts, photographs, illustrations, visual identity, KELIA brand) are protected by intellectual property rights and remain the exclusive property of KELIA. Any reproduction, representation, or exploitation, total or partial, without prior authorization is strictly prohibited.
Article 15 – Liability
KELIA's liability cannot be engaged in case of indirect, unforeseeable damage or resulting from a force majeure event. KELIA undertakes to implement all necessary means to ensure the proper execution of its obligations.
Article 16 – Mediation
In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, KELIA adheres to a consumer mediation service. The mediator's contact details will be communicated later and will appear on the website.
In case of dispute, the customer can submit their complaint to the competent mediator:

Article 17 – Applicable Law and Competent Jurisdiction
These General Terms and Conditions of Sale are subject to French law. In case of dispute, the parties undertake to seek an amicable solution before any contentious action. Failing an amicable agreement, the dispute will be brought before the competent courts.
